Agreement

This Agreement is between the Law Offices of Norman Gregory Fernandez ("Attorney") and Client whose name is listed above and signed electronically below.

1. Scope of Representation. Attorney will prepare a California postnuptial marital agreement tailored to Client’s circumstances, attach required financial disclosures, and sign the agreement once completed. No court appearances, litigation, or appeals are included.
2. Fixed Fee. Client agrees to pay a flat fee of $845. This includes up to four (4) hours of attorney time. Almost all postnuptial agreements are completed within this time. Additional time is rare. If required, Attorney will obtain Client approval before billing $250 per hour beyond four hours.
3. Payment. The $845 flat fee is due upon signing. The fee is non-refundable once work begins, as professional time is reserved exclusively for Client.
4. Client Duties. Client agrees to fully complete the intake form and all financial disclosure documents provided by Attorney and cooperate fully throughout preparation.
5. No Guarantee. Attorney makes no guarantees regarding enforceability or outcome. All comments are professional opinions only.
6. Declaration Regarding Errors and Omissions. Attorney does not maintain errors and omissions insurance applicable to family law matters. Client acknowledges receipt of this disclosure.
7. Dispute Resolution. Any dispute shall be resolved by binding arbitration in Orange County, California, unless Client elects fee arbitration under Business & Professions Code §6200. By signing, Client waives the right to a jury trial for covered disputes.
8. Entire Agreement. This is the complete agreement and may only be modified in writing signed by both parties.
9. Conflict Check and Acceptance of Representation - Client understands and agrees that execution of this Agreement and/or payment of any fee does not automatically establish or confirm representation if a conflict of interest exists. Representation remains subject to completion of the Law Office's conflict-of-interest review procedures. In the event the Law Office determines that a non-waivable conflict of interest exists, or otherwise determines that representation cannot ethically proceed, the Law Office will promptly notify Client and any funds paid by Client that have not been earned or that must be refunded under applicable law and this Agreement will be refunded to Client. The Law Office reserves the right to decline representation where required by ethical obligations or applicable law.
10. Client Identity and Communications -Client understands and agrees that the Law Office represents only the individual identified in this Agreement as the client, regardless of whether another person pays all or part of the fee, assists with payment, participates in communications, or otherwise assists in the matter. No attorney-client relationship is created with any person other than the client identified in this Agreement.
Client further understands and agrees that the Law Office may communicate only with the client regarding legal advice, strategy, confidential matters, or other substantive communications unless the client separately authorizes disclosure in writing and such communication is ethically permissible. Payment of fees by another person does not create any right to receive confidential information, direct representation, or control the representation.
